Thank you for using Benne Analytics.
This document is intended for any and all customers who have either:
  • an account with us
  • had an account with us in past
Throughout this document, any reference to "company", "we", "us", "our" should indicate a reference to the brand Benne Analytics.
Similarly, any reference to "our product", "our products", "product", "products", "service", "services" should indicate a reference to the brand name Benne Analytics.
Any reference to "you", "customer", "consumer" should indicate a reference to you, the customer of our product and service.
We may, in future need to update these Terms of Service to comply with legal obligations, to comply with the laws of the land, and/or to comply with any privacy and customer protection laws and regulations. Any such changes would be reflected appropriately on our blog, and any major changes/updates communicated to our customers.

When you create an account with us to use our product and/or service, you are agreeing to the latest Terms of Service. This includes, but is not limited to, our existing products and features, as well as any products and features that we may add to our product and service offering in future.
In accordance with legal counsel, we feel it is prudent to highlight that there may be times and scenarios where we do not and/or are not exercising or enforcing one or more right(s) and/or provision(s) outlined within our Terms of Service. However, it must be understood that we reserve the legal right to exercise and enforce said rights and provisions, and by choosing not to do so at any time should not indicate waiving off that right or provision, neither temporarily nor permanently.

These Terms of Service do contain a limitation to the liability of Benne Analytics.
You should only choose to use any of our product(s) and/or service(s) if you understand that by doing so you are giving your explicit consent on agreeing to these Terms of Service. Any violation of any of the terms outlined in this document may result in punitive action. This includes, but is not limited to, suspension and/or termination of your account, and appropriate civil and/or criminal proceedings against violating party/parties.
If you have any concerns, comments or questions about the terms as outlined in this document, please contact us, and we will address your concerns the best way possible.

You and you alone are responsible for maintaining the security of your account. This includes, but is not limited to:
  • being careful about not sharing your account credentials with anyone else, no matter how trustworthy you may feel that person to be.
  • being careful about logging on to your account on a computer and/or handheld device you don't own.
  • being careful about accessing your account on public computers.
  • being careful about accessing your account over unencrypted or suspicious network connections.
We would not be responsible for any loss or damage from your failure to comply with the necessary precautions required to protect the security of your account. As such, we would not be liable for any damages, data loss, and/or any financial or punitive actions.

If you choose to share your login credentials, we would consider any activity made during such a transgression as an activity made by you, and as such you waive off any claims for compensation by any loss that may result because of such an action. Benne analytics cannot and will not be liable in any way for any loss or damage incurred because of such an infarction.

Any and all Benne Analytics accounts should be registered by humans only. Accounts registered by bots or other automated methods are not permitted, and any accounts that get flagged and identified as such may face immediate suspension and/or termination. In such an event, you would not be eligible to claim for a refund on the remaining period of the current billing cycle of any and all subscriptions that may be active on such account.

While you can create your account using any known or unknown name - real or otherwise, we strongly recommend using your legal full name and a valid email address.
Using your legal name adds an extra layer of security to your account, and it helps us identify the correct account owner in case your account access is ever compromised. In case you are not able to access your account and your recovery email, and want to regain access to your account, we may be able to verify your identity using a government issued photo id card (such as your passport, driving license, voter registration etc), in which case having your account associated with a legal name instead of a fictitious one comes in handy.

You must not use our product and services if you are involved in any illegitimate and/or illegal business, or in violation of any civil or criminal laws in your jurisdiction.
You may not use our service for any illegal purpose or to violate any laws in your jurisdiction.

Subscriptions to Benne Analytics are metered. That means there are limits associated with your account. The limits could be in terms of the pageviews you websites generate, the number of websites you can add to your account, the number of members you can add to your account etc.
If your account type allows for extension of these limits by adding add-ons, you would be able to do that from your accounts management page in your settings. If not, you would need to upgrade your account type before you can add add-ons to your account.
While we occasionally grant free extensions on limits to particular account types based on limited-time promotions and other customer engagement and loyalty initiatives, in general, you would be expected to stay within the limits imposed by your account type. The limits on each account type are explicitly mentioned in the plans and pricing, and you are expected to review the limits attached to your account type when you choose a subscription.
The limits associated with your account, unless specified, are on a monthly rolling basis and are not carried over. So, any unused portion of your limits gets forfeited at the end of the month and the limit counters are reset.

There are two billing cycles for any subscription - monthly and annually.
Your billing cycle starts from the date you first purchased a subscription. For example, if you subscribed on the 4th of a calendar month, your billing cycle would be as follows:
  • For monthly subscription, 4th of any calendar month to 3rd of the next calendar month.
  • For annual subscription, 4th of that calendar month to 3rd of the same calendar month the next year.
Payments for any billing cycle are made in advance on the last day of the billing cycle coming to an end. For example, in the above example, you would be billed for the billing cycle May 4 - June 4 on the 3rd of May.

At any time during your active subscription, you would be free to scale up or down your subscription type based on your expected usage of the product and its features.
Since different subscriptions are at different price points, this change affects your billing to some degree. To that end, the following describes how your billing behavior gets modified every time you scale up or down your subscription:
  1. 1.
    Irrespective of whether you are scaling up or down your subscription, your billing cycle stays the same, i.e. if you first started using the product on the 4th of a calendar month, your billing cycle continues to be from 4th of a calendar month to the 3rd of the next calendar month.
  2. 2.
    If you are scaling up a subscription, it is assumed that you would want access to the benefits of the advanced tier immediately. Therefore, an additional invoice would be raised for the remainder of your ongoing billing cycle. The amount of this invoice would be calculated on a pro-rata basis based on the number of days left in the current billing cycle and the difference in the subscription fee of the two subscription types in question. Once the current ongoing billing cycle is over, your next invoices would be generated based on the charges associated with your new subscription tier and your card would be charged appropriately.
  3. 3.
    If you are scaling down a subscription, your new subscription will get activated only when the current ongoing billing cycle has ended. We would not be able to adjust a pro-rata balance of your current month to accommodate your new subscription.
The same conditions hold true irrespective of whether you are on a monthly or yearly subscription.
Scaling down a subscription may result in loss of features, and capabilities with respect to adding team members, setting up custom alerts, goals, and/or lab integrations. Please review the differences between your two subscription types before you confirm such a scale down. Benne Analytics would not be responsible for any loss of capabilities and features as a result of such a.voluntary scale down exercised by you.

All new accounts have a default 30 day no risk cancellation of their subscription. During these 30 days, if you aren't satisfied with the product and its features, you can cancel your subscription and we would process a reversal on your transaction.
Post 30 days, there are no refunds on transactions already made for your subscription.
The 30 day refund policy is applicable only for new accounts and/or first time customers of the product. If you are an existing customer, unless explicitly specified, the 30 day refund policy is not applicable to any of your previous, current or future transactions.

You are always free to cancel your subscription, but the charges made for your current billing cycle will stand as they are and there would be no partial or full refunds on the transaction in question. This is applicable to both monthly as well as annual subscriptions.
Payments for your subscription are in advance and made one day prior to the start of your next billing cycle.

When you cancel your subscription, we would stop measuring any future traffic metrics. You would continue to have limited access to your account and/or dashboard so that you can download your historical traffic data. Your data is always yours and we own no rights to it whether you are paying customer or not. So even in event of cancellation, we do not restrict your access to your data.
This access however is not lifetime. Once the account has been cancelled, you have 30 days to access and download your data. Once it has been deleted from our secure servers, there would be no way for us to help you restore or retrieve this data for you.

Your account remains active for as long as you want. There are only a couple of ways in which your account can be terminated:
  • You no longer wish to use the services and want to delete all historical data from our secure servers.
  • You violate the terms and conditions you agreed to when you signed up to use Benne Analytics.
  • You haven't paid for your subscription for more than 90 days.

If you do not pay for your subscription, you lose access to the growth dashboard. The insights algorithm would stop working on your account and you would not be receiving growth enabling actionable tips and insights for your business. We consider such accounts to be dormant.
If you still have the measurement script embedded on your website, the system will continue to measure and monitor your traffic stats for you to account for the possibility that you have simply forgotten to renew your subscription and may return. If you do so, then you will regain access to your dashboard and all data measured during this dormant phase on reactivation of your subscription.
If you renew your subscription within 30 days of it going dormant, your subscription will get reactivated automatically without any additional charges to your account. Post 30 days, a reactivation fee of $50 would be applicable.
In any case, there would be no insights recorded during dormant phase of your subscription. So while you would have access to the measured traffic metrics, there would be no insights available for the dormant period. Insights algorithm would resume functionality on your account once reactivated and you would get all future insights as normal.
If your account has been dormant for more than 60 days, we would send you weekly emails to ask you to request a dump of your historical traffic data. Post 90 days of dormancy, we may delete the traffic data associated with your account from our servers, in which case you would not be able to access it in future.
Before we delete the traffic data from our servers, we would send you a link to download it for your records. These links would only be active for 14 days during which you would be able to download the data. Once these links have expired and we have deleted the data from our servers, it would not be possible for us to restore your data under any circumstances.

We reserve the right to comply with legal, judicial, legislative and regulatory authorities as required by us to the extent of law.
We also reserve the right to refuse service to anyone for any reason at any time. If we discover your site to be harmful to visitors in any way, and/or find you engaged in illegal or unethical practices, we reserve the right to cancel your account immediately. There would be no refunds in case of such cancellations.
We believe in a tolerant worldview and peaceful resolution of conflicts. As such, any verbal, physical, written, oral or other abuse of any kind either to Benne Analytics representatives or customers in general may be grounds of suspension and/or termination.
You must not create another website, or modify an existing website so as to falsely imply that it is in any way associated with Benne Analytics directly or indirectly. The look and feel of our products and services is copyright © to Benne Analytics. All rights reserved. Benne Analytics, the logo and any other assets (text, graphic or otherwise) displayed on our website, in our ads, emails, landing pages etc. are trademarks of the brand and may not be copied, imitated or used, in whole or in part, without the prior and explicit written permission of the brand or the applicable trademark holder.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, or access to the service without the express written permission by the company.

Benne Analytics unequivocally reserves the right to amend our terms of service at any time for any reason. We may need to, from time to time, change our terms of service in accordance with legal counsel, or to comply with changes in consumer privacy and safety regulations. In the event of any such necessity, we reserve the right to amend our terms of service. Any such amendments would be communicated via our blog when required, but it would not be considered an obligation for us to do so.
We also reserve the right at any time to modify or discontinue, temporarily or permanently, any part of the service with or without notice.
The pricing structure for our products is subject to strategic decisions taken by the relevant stakeholders, and would always be determined keeping our customers' best interests in mind. However, we unequivocally reserve the right to amend our subscription plans in any way deemed fit. This includes, but isn't limited to, the inclusions in each plan, the pricing structure of each plan, the price point of each plan.
If changes to our pricing negatively affects our existing customers, whenever possible, we may exempt them from being affected by the changes, either temporarily or permanently. While we would be under no obligation to do so, we would let the existing customers remain on their original subscription plans for as long as possible for us. The duration of this extension is subjective to market conditions, and whenever applicable we would communicate the same to our customers. At any time, existing customers would receive at least one full billing cycle's notice before they are migrated to the new pricing structure.
We can not and shall not be held responsible and liable to you or any associated or non-associated third party for any such modifications, changes, alterations, suspensions or discontinuation of our products, features within our products and/or services.

You would be considered the sole and absolute owner of, and would be solely responsible for any content and/or any other material you submit to us in any form while using our products and services.
We claim no intellectual property rights over any material you provide to us while using our products and services. All data, traffic data or otherwise, that we get access to via you, continues to remain your property.
If you violate the intellectual property rights of any third party, you would be solely responsible for any punitive actions, fines and punishments caused as a result of your violation of their intellectual property rights. We do not verify your ownership of the data you submit, and assume you own the absolute rights to any and all data you submit to us via different routes. Therefore, Benne Analytics will not be held liable for any violation made by you to someone else's intellectual property rights.
From time to time, you may provide us with feedback, suggestions, and ideas about our product and/or service. You agree that we own all rights to use and incorporate the feedback you provide in any way, including in future enhancements and modifications to the service. Any such incorporation resulted because of your feedback would be owned by us, and we would not be required to facilitate any payment or attribution to you for sharing that feedback, suggestion and/or idea.

We take many measures to protect and secure your data through backups, redundancies, and encryption. When you use our service to measure your website traffic and other metrics, Benne Analytics will collect information about your visitors.
Each party agrees to handle the other party’s data in accordance with (i) all applicable laws; and (ii) privacy and security measures reasonably adequate to preserve the other party data’s confidentiality, expectations and security.
You own all right, title, and interest to your website data. By using our products and services, we do not obtain any rights from you to your website data. We do not collect and analyze personal information from web users and we do not use behavioral insights to sell advertisements. We will never collect or store any personally identifiable information and we will never abuse your visitor’s privacy. The ownership and control of your website data belongs 100% to you. We will never sell or share your site data to any third-parties.
You agree to comply with all applicable laws including all privacy and data protection regulations.
You agree not to use the service to send sensitive information to the company where unauthorized disclosure could cause material, severe, or catastrophic harm or impact to the company, any data subjects or third-parties. Sensitive information includes, but is not limited to credit card information, passport numbers, government issued identification numbers, financial account information, real time geolocation and personally identifiable information (PII). PII is information that could be used on its own to directly identify, contact, or precisely locate an individual.

Your use of Benne Analytics is at your sole risk. The service is provided on an “as is” and “as available” basis. We do take uptime of our application seriously.
We design our services with care, based on our own experience and the experiences of customers who share their time and feedback. And we continue to work on our services to make them more and more valuable to our customers. However, we make no guarantees that our services will meet your specific requirements or expectations. In case you are not 100% sure about the capabilities of our product, you can contact us with any and all questions you have and we will try to best answer/address them.
We also test all of our features extensively before shipping them. As with any software, our services inevitably have some bugs. We track the bugs reported to us and work through priority ones, especially any related to security or privacy. Not all reported bugs will get fixed and we cannot guarantee completely error-free services.
Technical support is provided by email. Email responses are provided on the reasonable effort basis without guaranteed response time. In order to help you with your support request and/or to maintain and safeguard the quality of our services and security of your data, we may need to access your data from time to time. Any such access is solely to assist your usage of the product and is not done with any malicious intent whatsoever.
